The Investigator III position is responsible for processing and investigating earned paid sick time and minimum wage complaints, fielding earned paid sick time questions, investigating potential earned paid sick time and minimum wage violations and submitting proposed penalties to the Industrial Commission of Arizona (the Commission) for approval. 


The Investigator will receive and review earned paid sick time wage claims and complaints of non-compliance by the employer; receive and review minimum wage claims filed by claimants against employers; send initial inquiry letters to employers, examine evidence and documentation received from employers to determine if non-compliance issues exists; evaluate evidence for level of non-compliance and take appropriate steps to get the employer into compliance.  Review earned paid sick time and minimum wage files for possible wages owed to claimant by employer; communicate with the public on a daily basis via face to face, telephone, mail and email; answer questions from both employers and claimants regarding earned paid sick time and minimum wage law; travel to various locations within Arizona to conduct investigations; keep up to date on new rule and law changes referencing earned paid sick time and minimum wage; submit narrative reports and determinations based on investigative findings for review by supervisors and the Commission; testify before the Commission in support of investigative findings; speak in public group discussions, special interest and stakeholder meetings to present earned paid sick time and minimum wage information and answer questions and concerns by the general public.

·         AZ Driver’s License Required

In-State travel is required in this position approximately 20 to 30% of the time.  Requires possession of and ability to retain a current, valid state-issued driver's license appropriate to the assignment.  Employees who drive on state business are subject to driver's license record checks, must maintain acceptable driving records and must complete any required driver training (see Arizona Administrative Code R2-10-207 (12)). Employees may be required to use their own transportation, as well as maintaining valid motor vehicle insurance and current Arizona vehicle registration; however, mileage will be reimbursed.       


Knowledge of:

·         The Arizona Labor Department's statutes and rules relating to minimum wage claims (A.R.S.23-362 to 23-364) and (A.A.C. R20-5-1201 to R20-5-1220).

·         Statutes and rules specifically relating to the earned paid sick time (A.R.S. 23-371 to 23-381) and (A.A.C. R20-5-1201 to R20-5-1220).  Federal laws FMLA and FLSA and how they relate to state employment issues.

·         Ability to decipher various forms of wage related documentation.

·         Investigative and analytical techniques.

·         Microsoft Office Word, Outlook, Excel and Power Point.

·         Negotiation and mediation skills.

·         Logic and analytical skills.

·         Analyze business policies, employment agreements and wage payment policies that apply to commissions, bonuses, overtime and vacation leave.

·         Communicate effectively and write clearly.

·         Articulate statutes and rules under the Division’s jurisdiction to concerned parties.

·         Control adverse situations and work with disgruntled claimants and employers.

·         Recognize and engage those with different backgrounds, characteristics, and perspectives to bridge gaps in understanding of differing viewpoints, as well as ensuring  persons with diverse perspectives are given the opportunity to collaborate and provide input in the decision process.




Ideal candidates will have:

·         Three years of experience in conducting complex regulatory investigations.

·         Course or training in investigation technique and procedures.

·         Training in legal procedures pertaining to regulatory investigations.
