The Arizona Department of Agriculture is currently recruiting for a Weights and Measures Investigator in Mohave County and surrounding areas for the Weights and Measures Services Division. 

The Division’s primary mission is to promote equity and fairness of Arizona commerce involving weighing or measuring for commercial purposes by regulating and supporting businesses in a manner that protects both the buyers and sellers interests.  The Division carries out its mission by maintaining the State standards of weight and measure based on national standards maintained by the Federal government, licensing weighing and measuring devices used in Arizona, conducting a wide variety of inspection programs to protect the marketplace, and auditing measuring devices and enforcing the statutes, rules, and regulations governing their use.

 

JOB SUMMARY:

Conduct independent investigations of commercial weighing, timing and counting devices to determine if they are accurate and are in accordance with nationally recognized technical requirement; conduct independent examinations of commercial volume measuring devices to determine if they are accurate and in compliance; conduct compliance investigations at retail, wholesale and point of pack relating to the net contents of packaged goods; conduct inspections at retail locations of scanning devices and to ensure the retailer is in compliance with state price posting requirements for goods that are exposed or offered for sale; conducts independent testing of mandated annual vapor recovery systems as well as random compliance inspections which may include increased frequency or targeting of inspections, increased sampling frequency, use of portable analyzers or any other techniques and procedures from pipelines, storage terminals, retail sellers, and transports to a contracted laboratory for analysis samples of motor fuel quality essential to meet EPA clean air initiative requirements.  Interprets technical, statistical, and engineering data to determine compliance with state and federal laws based upon legal interpretation of the National Institute of Standards Technology (NIST) handbook, insurance, California Air Resources Board (CARB), Environmental Protection Agency (EPA), federal motor carriers, state and federal criminal laws, issue enforcement actions; to include stop use, hold, warning, unlicensed device and removal orders, this to include closing businesses until compliance is achieved.  Educate the public and industry as to the appropriate practices and policies.  Testify as an expert witness at hearings held by the Office of Administrative Hearings or participate as a Department Representative in Informal Settlement Conferences.  Other duties as assigned.

 

Extensive travel is required and your case load will require you to work out in the elements 80% of the time.

 

Knowledge of:

Knowledge of federal, state, local, tribal and agency laws, rules, regulations and policies governing the installation and accuracy of commercial weighing devices; labeling and accuracy of contents of packaged products; CARB regulations relating to vapor recovery systems and air quality standards; volumetric examination requirements for motor fuel; dispensing devices; and motor fuel quality standards.

Knowledge of techniques and methods employed to determine accuracy and compliance of devices, labeling standards, vapor recovery systems, motor fuel quality and measurement. Technical methods and standards as defined in NIST Handbook.  Investigative rules, policies and procedures relating to program non-compliance; knowledge of the legal process, collection of evidence and case documentation; knowledge of chain of custody procedures for the proper handling and transport of motor fuel samples. 

 

Skills in:

Skilled in interpreting federal, state, local, tribal and agency law, rules, regulations and policies governing the installation and accuracy of commercial weighing devices; labeling and accuracy of contents of packaged products; CARB regulations relating to vapor recovery systems and air quality standards; volumetric examination requirements for motor fuel; dispensing devices; and motor fuel quality standards.

Skilled in written and verbal communication; developing professional relationships and effective interpersonal relationships.

Skilled in report writing and investigation techniques.

Skilled in the use of computer hardware and software related to the job assignment.

Prioritizing work load with limited supervision.

 

Ability to:

Work independently and prioritize work load with minimal supervision.

Maintain good working relationships with internal and external customers.  Develop business relationships with other enforcement personnel, such as city and county law enforcement, fire department personnel, and tribal leaders.

Take enforcement action when needed to stop sales, hold or remove commodities or devices from commercial use until the business is in compliance with all pertinent laws and rules.  Take civil action for repetitive non-compliance practices or when a major infraction of the law or rules is detected. Testify as an expert witness at hearings held by the Office of Administrative Hearings or represents the Department in Informal Settlement Conferences.

Special Job Requirements:  In-state travel required.  Requires possession of and ability to retain a current, valid Arizona state-issued driver’s license appropriate to the assignment.  Employees who drive on state business are subject to driver’s license record checks, must maintain acceptable driving records and must complete any required driver training (see Arizona Administrative Code R2-10-207.12

Positions in this classification participate in the Arizona State Retirement System (ASRS).  Mandatory condition of Employment for all employees who meet the eligibility and membership criteria defined in statue.  Current contribution rate is 12.11%.  Enrollment eligibility will become effective after 27 weeks of employment.
